Abstract


Facebook, a social networking site, has seen tremendous growth over a short  period of time. It has become the focus of many academic and industry research studies, some relating to privacy, identity management, and the effects of online interaction on social capital, among others. Little research has been done on the legal and ethical aspects of Facebook and the privacy implications of new web technologies. The creation of Social Network Sites is not without its dangers and detractors.  This investigation looks at the way that South African and New Zealand privacy legislation challenges the terms of use provisions of Facebook. We anticipate that contemporary users of Facebook could live to regret their participation in future. We ask the question, ‘what legal recourse would a South African have in the event of a dispute with Facebook?’
